미국 기항 관련, ELECTRONIC NOTICE OF ARRIVAL/DEPARTURE(e-NOA/D) 내용 및 관련 약관 소개

1. 목 적
미국 영토 보안을 위한 신설 절차로서, 미국항 입출항하는 모든 선박(항공기 포함) 탑승자(선원 포함)의 신상(Crew Menifest)을 미국 당국에 사전 통보.
2. 절차수립 경위
기존 U.S. Customs & Board Protection(CBP)의 Advance Passenger Information System(APIS)과 U.S. Coast Guard(USCG)의 Notice of Arrival(NOA) 절차를 통합하여 The New Combined CBP / USCG Electronic Notice of Arrival & Departure(eNOA/D) Transmission System and Process라고 칭하는 새로운 절차가 수립됨 .
3. 내 용
가. 관련 법률(APIS)
2005년 4월 7일 미국 연방 관보(Federal Register)에 공표된 The Advance Passenger Information System(APIS) Final Rule이 2005년 6월 6일부로 발효됨에 따라, 모든 상선(상용 항공기 포함)은 미국 도착전에 그 선원(Crew Menifest Details) 및 여객에 대한 내용을 CBP에 제출하여야 하며, 또한 유효한 International Carrier Bond(ICB)를 사전에 U.S CBP에 등록하여야 함.
나. 통지 관련
ㅇ 통지 내용 : Notice of Arrival, International Ship Security Certificate, Crew List, Non-Crew & Passenger List 등.
ㅇ 통지 방법 : Electronic Data Interchange System을 이용하여 통지함.
- Off-Line 통지시 : 전자우편(e-mail)으로 통지
- On-Line 통지시 : USCG Natonal Vessel Movement Center(NVMC) 홈페이지를 통한 통지
ㅇ 통지 기한 : 항해시간 96시간 이상시 - 최소 도착 96시간(4일) 이전
항해시간 96시간 미만 및 24시간 이상시 - 최소 도착 24시간(1일) 이전
항해시간 24시간 미만시 - 이전 항구 출항전
ㅇ 통지처 : USCG 및 CBP(USCG 소속 NVMC에 통지함으로서 CBP에도 자동 연결/통지됨)
다. e-NOA/D를 위한 International Carriers Bond(ICB) 요구
(1) ICB는 e-NOA/D(Crew Menifest) 관련 문제 발생시 미국 정부에 대하여 금전적 담보를 해 주는 보험증권 성격을 가지고 있음.
* 기존 AMS(Cargo Menifest) 관련 ICB는 그 성격상 화물 관련 문제에 대한 금전 담보 증권.
(2) Advance Passenger Information System(APIS) Final Ruls에 의거, 승객 또는 선원이 승선한 선박의 국제 운송인은 ICB를 보유하여야 함.
(3) 시행 초기 ICB 보유 하지 않은 선박은 1차 입출항시 서면 경고를 하고, 재차 입항시에는 제재 조치(벌금, 입출항 지연, 및 입출항 거부 등) 취해졌으며, 2006년 2월 1일부터는 전면 실시됨.
4. 문제점 및 대처 방안
가. 미통지 등으로 손해 발생시 계약상 책임 주체
본 통지는 주로 선원 등 승선 인원에 관한 통지이므로, AMS와는 다르게 선주 책임으로 볼 수도 있겠으나, 특정 항(미국항)에서만 특별히 비용이 발생(ICB 발급 비용 등)하고, 본 절차 실행이 얼마되지 않은 점 등을 고려하며, 문제 발생시 선주와 용선자 사이에 분쟁 발생의 여지가 많으므로, 아래와 같은 약관의 삽입으로 분쟁의 소지를 사전에 방지하는 것이 바람직함.
나. 추천 약관 : HJS e-NOA/D Clause
"HJS U.S. Electronic Notice of Arrival/Departure(e-NOA/D) Clause for Time Charter Parties"
(a) If the Vessel calls at any port(s) or place(s) in the United States, including any United States territories, the Owners/Vessel shall submit an electronic notice of arrival/departure (E-NOA/D) in advance of departure from or arrival at such port(s) or place(s) to the U.S Coast Guard and/or US Customs & Border Protection(CBP) and/or the National Vessel Movement Center(NVMC) in compliance with US Coast Guard's arrival and departure reporting requirements, CBP Advance Passenger Information System(APIS), and the new combined CBP/U.S Coast Guard(USCG) Electronic Notice of Arrival and Departure(eNOA/D) transmission system and processes or any subsequent amendments thereto in order to obtain entry and departure clearance from the relevant U.S authorities, and the Owners/Vessel shall undertake the role of carrier for the purposes of such regulations/requirements/systems/processes and shall, in their own name, time and expense, ensure that they have a valid ICB (International Carrier Bond) for the notice.
(b) The Owners assume all liabilities for and shall indemnify, defend and hold harmless the Charterers against any loss and/or damage whatsoever(including consequential loss and/or damage) and/or any expenses, fines, penalties and all other claims of whatsoever nature, including but not limited to legal costs, howsoever arising from the Owners’failure to comply with this clause.
(c) Should such failure result in any delay then, notwithstanding any provision(s) in this Charter Party to the contrary, the Vessel shall be off-hire for the time lost.
* 약관 요점
e-NOA/D 관련 부적절한 통지 또는 무통지로 인한 운항지연 등에 대하여 계약상 선주책임을 명확하게 함. 즉, 선주는 본 통지를 적절히 하여야할 책임이 있으며, 부적절한 통지 등으로 인한 용선자의 손해에 대하여 선주는 배상하고, 관련 시간 손실은 off-hire 처리됨. 끝.
