화물검사(Cargo Inspection) 실패와 준비완료통지(Notice of Readiness)의 유효성

1. 사건개요

 

2002년 3월 1일 미국 텍사스 Corpus Christi에서 밀가루 11,000톤을 선적한 ‘Stefania 1’호는 양륙항인 페루 Matarani에 2002년 3월 14일 21:20에 도착 후 준비완료 통지 및 검역검사(통과)를 받았다. 그러나 화물서류(phytosanitary certificate)의 미비로 화물검사가 지연되어 선박은 2002년 3월 18일경에나 접안하여 양륙작업이 가능하였다.

 

 

2. 관련 규정

 

제18조 제a항

Notification of vessel’s readiness to load and discharge at the first or sole loading and discharge port shall be delivered in writing at the office of Charterers/Receivers between 0900 and 1600 on all days except Saturday, Sunday and holidays. Such notice of readiness shall be delivered when the vessel is in the loading or discharging berth and is in all respects ready to load/discharge, including free pratiques whether applicable, if vacant, failing which from a layberth or anchorage within the limits of the port, or otherwise as provided in Clause 18(b)

 

제52조

At both Load & Discharge ports vessel to tender Notice of Readiness via tlx/VHF/phone/email after having complied with local inspection, including agriculture/sanitary authorities during regular office hours from 0900 hrs to 1600 hrs on Mondays through Friday excluding Saturdays, Sunday days and holidays, and time shall then start at 0800 hrs on the next working day not excepted vessel in all respects ready to commence cargo operations.

 

제10조 제a항

Cargo is to be discharged free of expense to the vessel.

 

제18조 제c항

Following receipt of notice of readiness laytime will commence at 0800 on the next day not excepted from laytime.

 

제19조 제c항

Vessel is to be discharged at the average rate of 3,000tons of 1,000kilos per weather working day of twenty four(24) consecutive hours. Saturdays, Sundays and Holidays included on the basis of the Bill of lading weight.

 

제20조

Demurrage at loading and/or discharge ports is to be paid at the rate of US$7,000 per day or pro rata for port of a day… Any time lost for which Charterers/Receivers are responsible, which is not excepted under this Charter party, shall count as laytime, until same has expired , thence time on demurrage.

 

 

3. 당사자 주장

 

가. 운송인

 

(1) 준비완료통지 무효

 

본선의 입항직후 준비완료 통지는 용선자의 화물증서 미비로 항만당국의 검사가 완료될 수 없는 상태에서 발송되었기에 상기 제52조 위반으로 무효이다.

 

(2) 지연배상청구

 

용선자의 귀책으로 정박기간의 개시가 불가능하였기에 용선자는 체선료율 상당의 지연손해와 동기간의 연료소모에 대하여 배상하여야 한다.

 

나. 용선자

 

(1) 정박기간 규정 적용(별도 지연(detention) 규정 없음)

 

본계약상 지연(detention) 관련 규정 없으며, 당해 제20조에 의거 용선자 귀책 시간손실은 정박기간으로 정산된다.

 

(2) 유효한 준비완료통지

 

도착 직후 통지된 준비완료는 계약상 유효하며, 설사 당시 유효하지 않았다 하더라도 용선자의 이의(protest or objection) 없는 접수 등으로 그 하자가 치유되었다.

 

(3) 준비완료통지 전제의 검사(inspection)의 범위 - 화물 검사 또는 선박검사

 

지연된 검사는 선박검사가 아니라 화물검사이므로 제52조상 준비완료통지를 조건인 검사에 해당되지 않는다.

 

 

4. 중재판정

 

항만당국의 화물검사는 당해 제52조에 포함되지 않는다. 즉, 준비완료통지를 위한 검사는 선박자체에 대한 검사만을 의미하므로, 본선이 도착직후 통지한 준비완료는 유효하다. 

 

 

5. 결 어

 

가. 준비완료통지를 위한 검사 범위(화물관련 검사 제외)

 

원칙적으로 선적항 및 양륙항, 특히 양륙항 입항시 선박은 검사(inspection)을 받고 이를 통과하여야만 정당한 준비완료통지(Notice of Readiness)를 할 수 있다. 이때 선박이 수검하는 검사는 여러 종류가 있으며, 그 중 화물자체에 대한 검사도 포함되는데, 이 때 화물품질의 이상 및 화물관련 증서 등의 미비로 사항은 정박기간을 개시하기 위한 운송인의 준비완료통지를 방해하지 않는다.

 

나. 운송인 귀책으로 인한 화물검사 등 지연시

 

원칙적으로 화물관련 증서는 용선자가 준비하는 것이기 때문에, 이러한 증서의 미비로 인한 화물검사 지연에 대하여 준비완료통지를 불허할 이유가 없으나(본 판례처럼), 만약 선박의 과실로 화물손상이 발생하고 이로 인하여 화물검사가 불합격되어 하역작업(접안 등)이 지연될 경우, 이 때에도 준비완료통지를 당연히 허용되어야 하는가가 문제가 된다.

 

생각컨대, 본 판례를 충실하게 따르면 운송인의 귀책과 상관없이 일단 선박자체가 하역작업을 하는데 문제가 없다면 정당한 준비완료통지는 가능할 것이고, 다만 추후 화물손상으로 인한 용선자의 시간손실은 관련 규정에 따라 정박기간에서 제외하던가 또는 별도의 손해배상차원에서 처리하여야 할 것이다. 끝.
