항해 중 용선자의 화물 훈증소독 요청에 대한 본선 및 법적 대처 방법

* 본 글의 목적은 항해 중 훈증소독에 관련된 위험을 살펴보고, 이에 대한 선주 위험의 최소화 방법과 법률적(계약상) 대응방법을 살펴보기 위함으로, 원칙적으로 선박과 선원의 안전을 위하여 항해 중 화물훈증소독은 최대한 자제하여야 한다.

1. 훈증소독 목적

훈증소독은 독성기체(살충제)를 선창 등에 주입으로 해충 등을 구제하여 화물손상을 방지하기 위함이다. 이러한 훈증소독은 선적 전후에 실시될 수 있으나, 일반적으로 송하인 및 용선자는 운송 중 훈증소독으로 정박시간을 줄이기를 원한다.

2. 훈증물질 종류

흔히 훈증소독으로 사용되는 물질로는 Aluminum Phosphide, Magnesium Phosphide, Gastoxin 또는 Magtoxin 등 Phosphine-evolving gas(Hydrogen Phosphine)가 있다. 이러한 물질은 고체형태로 적화물 위에나 그 바로 밑에 놓아둔다. 한편, Methyl Bromide는 실린더에 기체상태로 주입되어, 선창과 통하는 관을 통해 훈증소독을 하게 된다. 이 Methyl Bromide를 사용한 소독은 운송 중 허용되지 않으며, 훈증시 선원들은 하선하여야 한다.

3. 훈증소독 위험성

훈증기체는 인체에 유해할 뿐만 아니라, 흡입시 호흡기 질환 등을 일으키고 종국적으로 질식을 유발할 수 있다. Phosphine-evolving gas(Phosphine-generating fumigation)가 선원들이 승선 중에 사용되어 선원의 질병 또는 사망사건들이 발생한 적이 있으므로, 이 가스(Aluminum Phosphide, Magnesium Phosphide)를 사용할 때는 특히 조심하여야 한다.

또한 훈증에 보통 사용되는 기타 소독가스는 농축시 가연성이 되며, 또한 물과 접촉시 발화 또는 폭발할 수 있다.

4. 훈증소독 절차 준수

훈증소독은 전문적 기술과 특수장비가 필요하므로 적절한 절차를 준수하여 사고를 방지하여야 한다. 또한 훈증소독은 선원이 관련 자격과 훈련을 받고 있지 않는 한 선원들에 의해 수행되어서는 안 된다.

훈증소독 관련 규정(절차)로는 IMO 1996 Recommendations on the Safe Use of Pesticides in Ships과 IMO 2001 Code of Safe Practice for Solid Bulk Cargoes(BC Code)(Section 3-Safety of Personnel and Ship) 등이 있으며, 훈증소독 관련 자세한 안내가 기재되어 있다.

5. 손해방지 대책

가. 사전 검사

운송 중 안전한 훈증소독 여부를 파악하기 위해 선장과 송하인 또는 용선자가 지명한 훈증소독 담당자가 사전검사를 실시한다. 이러한 검사를 통해 관련 선창의 가스누출 가능성을 확인할 수 있다.

선주는 훈증소독 담당자에게 그 자격 및 송하인 및 용선자로부터의 지명에 대한 입증자료의 제출을 요구하여야 하며, 검사 후에는 그 담당자에게 훈증물질의 종류와 양, 위험, 기타 선장에 알아야 할 안전사전 대책에 대한 정확한 의견을 포함한 훈증소독 절차계획서(intended fumigation procedure)와 사전 검사결과서(pre-fumigation inspection)를 서면으로 요구하여야 한다.

나. 절차 숙지

선장은 훈증소독전 관련 선원들에게 훈증물질 표식, 보호장구 및 안전/비상 절차를 숙지시켜야 한다.

다. 장비

훈증소독 담당자는 선박의 장비가 정상여부 및 IMO 권고에 따른 표본채취 여부를 확인하여야 하며, 관련 선원들에게 장비사용방법을 반드시 시범 보여야 한다.

라. 훈증개시 및 유출 점검

훈증소독은 모든 화물작업이 완료되고 비관계자(unauthorized personnel)가 본선 위험구역을 벗어난 후에 개시되어야 한다. 훈증소독 담당자는 모든 선창의 가스누출 점검 및 밀봉과 선박 주거구역에 가스유입이 없음을 증명하는 증서를 제출하여야 하며, 이 제출 후에 비관계자가 승선할 수 있다.

마. 경고표시 및 위험구역 출입통제

모든 선원에게 훈증소독 구역을 인지시켜야 하며, 위험구역 출입구는 훈증소독 담당자가 서명하고 날짜를 기입한 ‘Poison Gas’ 경고표식을 부착하여야 한다.

바. 항해 중 감독

항해 중 수시로 주거 및 작업구역의 가스농도를 점검하여 만약의 가스누출 사고에 신속히 대처한다.

사. 훈증가스의 방출

훈증소독 담당자는 훈증가스의 방출방법에 대한 지시서를 발부하여야 하며, 방출가스가 밀폐된 주거구역 및 작업구역으로 바람에 날려가지 않도록 하고, 선창에 사람의 접근을 막아야 한다.

아. 훈증 잔존물 처리

훈증소독 담당자는 훈증 잔존물 처리에 대한 지침을 내려야 하며, 양륙항 육상인부에 의하여 처리될 경우, 이러한 화물 관련자에게 양륙개시전 본 지침이 전달되어야 한다.

6. 법적 문제

가. 훈중소독 허용에 관한 선장의 절대적 권한

선장은 운송 중 훈증소독 실시여부에 대한 절대적 권한이 있으며, 또한 선박 및 선원 안전을 위하여 일정한 조건을 요구할 수 있다. 훈증소독에 대하여 기국 및 항만국의 허가도 통상 요구된다.

나. 운송 중 훈증소독(in transit fumigation) 허용시 선주 대처방법(용선계약상)

(1) 선장의 최종적 판단으로 제반 조건이 적절하지 않을 경우, 운송 중 훈증소독을 거부할 수 있는 명시적 권리 규정(용선계약서상) 기재.

(2) 훈증소독이 용선자의 위험부담과 비용으로 실시된다는 규정 삽입.

(3) 훈증소독이 IMO 안내지침과 권고에 따라 수행된다는 규정 삽입.

(4) 훈증소독 관련 지시에 의한 모든 결과에 대한 용선자의 명시적 배상 규정 삽입.

다. Letter of Indemnity(LOI) 징구

(1) 효과

LOI 징구가 선장의 훈증소독 여부에 대한 절대적 권한을 약화시키지 않는다.

(2) LOI 모범

[With reference to clause [insert number] of the Charterparty,] We hereby request the owners of the Ship to fumigate the Cargo on board at the Ship while in transit to the discharge port. Such fumigation should be carried out strictly in accordance with our written instruction, which will be provided forthwith to the Master of the Ship. We warrant that the fumigation has been approved by the shippers and will be carried out by qualified personnel acting on our behalf and solely at our own risk and expense, in accordance with guidelines and recommendations issued by the international Maritime Organization.

In consideration of your complying with our above request, we hereby aggress as follows:

To indemnify you, your servants and agents and to hold all of you harmless in respect of any liability, loss, damage or expense of whatsoever nature which you may sustain by reason of fumigation the Cargo on board the Ship.

In the event of any proceedings being commenced against you or any of your servants or agents in connection with, or as a consequence of, the fumigation of the Cargo on board the Ship, to provide you or them on demand with sufficient funds to defend the same.

If the Ship, or any other ship or property in the same or associated ownership, possession, management or control, is arrested or detained, or threatened to be arrested or detained, or should there be any other interference in the use or trading of the Ship (whether by virtue of a caveat being entered on the ship’s registry or otherwise howsoever), in connection with, or as a consequence of, the fumigation of the Cargo on board the Ship, we warrant to provide on your demand such bail or other security as may be required to ensure the release from or prevention of such arrest or detention or other interference in the use or trading and to indemnity you in respect of any liability, loss, cost or expense caused thereby.

The liability of each and every person under this indemnity shall be joint and several and shall not be conditional upon your proceeding first against any person, whether or not such person is party to or liable under this indemnity.

This indemnity shall be governed by and construed in accordance with English law and each and every person liable under this indemnity shall at your request submit to the jurisdiction of the High Court of Justice in London and will, within seven days of a request so to do, appoint solicitors within the jurisdiction who are authorized to accept service.
